Our terms and conditions
Who we are
Membership (as defined below) is provided by Kay’s Counselling LTD, trading as “Kay’s Counselling” (“Kay’s Counselling”, “we”, “our”, “us”). Kay’s Counselling Limited is a limited company registered in England and Wales under company number 08263546, whose registered office is at 71 Vyse street, Jewellery Quarter, Hockly, B18 6EX.
The terms “you”, “your” and “yours”, when used in these agreement, refers to you as a Therapist.
Kay’s Counselling provides client’s with a platform to find a therapist they wish to work with, whether this is face-to-face, online or via telephone. When working with clients, you are entering into an agreement directly with the client and not with Kay’s Counselling. Kay’s Counselling will not be responsible for any agreement nor is party to any between you and the client. By completing the membership form you confirm you agree to the terms of this agreement.
You confirm that you have the relevant qualifications and or accreditation for any services you provide including, current insurance, accreditation or registration with a professional body (BACP, UKCP, BABCP, HCPC, NCS, BPS, BPC or any other body we may deem appropriate from time to time). All copies of the above details must be submitted to Kay’s Counselling prior to your membership starting. You must adhere to the professional code of ethics at all times. You confirm you will not provide any services where you do not hold the relevant qualifications. If at any time your insurance, qualification or accreditation lapses, is revoked or not renewed you must notify us immediately, you will not use our services if the above applies. You may continue your membership with us once the above has been reinstated and we confirm we are satisfied the issue has been resolved.
To be an active member of our website, you will need to provide us with relevant details such as photo, information, email address, home/work address and telephone number.
You must act in a professional, responsible manner throughout your work with clients and must be aged 18 or over to be a qualified therapist.
You agree that you will not under any circumstances:
- Create an account on behalf of anyone else
- Allow anyone else access to your account
- Impersonate another therapist
Kay’s Counselling reserves the right to approve or reject any application to join our website, at our own discretion.
Your profile can be viewed by anyone and will include information about you and your practice. You will need to ensure you have full permission to any videos/photographs or any blogs you submit to be added to the website and shared across social media.
You confirm all details provided on the membership form is accurate and up to date. You will need to ensure any changes in details are provided to Kay’s Counselling allowing us to update your record or profile.
All blog posts must be submitted electronically via email, word count needs to be 600-2000 words, all references used must be identified at the bottom of your blog. It is your responsibility to ensure you do not plagiarise other’s work, if you’re unsure of plagiarism, ensure you reference the author. Your blog posts must not be defamatory towards anyone. When submitting an article, you must ensure confidentiality is maintained at all times, ensure your article is fiction, anyone mentioned in the article can’t be identified in any way, if you do use any personal information, you must ensure you have gained consent from that individual in writing.
Copyright is maintained by Kay’s Counselling for any articles which are submitted, unless otherwise stated in writing from Kiran Mahboob, Director of Kay’s Counselling. When submitting articles, please include your contact detail, confirmation that confidentiality is maintained, any permissions or consent you have gained to disclose any personal information.
Session Price Structure
The fees you charge for your sessions will be determined by you, your rates are set at your own discretion.
The sessions and their contents are solely your responsibility, sessions must be conducted in line with the relevant professional bodies ethical framework and must be run a safe and professional manner.
We reserve the right to report any therapist we believe is acting in an unethical manner to the relevant professional body i.e. BACP/UKCP/NCS etc.
Payment for Sessions
Clients will pay you directly for your services. The commission will be invoiced to you at the end of each month and must be paid within 7 days of the date of invoice.
Other Important Payment Information
You must be registered as either self-employed or a limited company, you will solely be liable for any tax which is due from the monies you have earned. We bear no responsibility in respect of your tax liabilities, bank or payment fees.
No matter how much protection we have on the site, the security of information and payments over the internet cannot be guaranteed. We shall under no circumstances be liable for any losses incurred or sustained by users who transmit information by email or other internet links.
Suspending or terminating your membership
We reserve the right to immediately suspend or terminate your account if:
- you breach the terms laid out in this agreement
- any information you have provided is incorrect, misleading, fraudulent or causes a breach of these terms.
- You have broken the law, regulations or behaved in an unethical manner.
- You’ve cancelled/rescheduled or arrived late for 2 sessions or more
If we cancel your membership, you will not be referred any further clients.
Client’s may report you to Kay’s Counselling, if they believe you’ve accepted unethically or unprofessionally, we may suggest to clients that they contact your professional body if your behaviour is deemed unethical. Your membership may be cancelled, suspended or reviewed.
If you have any concerns about a client, you can report them to us by emailing enquiries@Kayscounselling.co.uk. Following the submission of any report, we may contact you for further information.
Variation of our terms
We may amend these terms at any time, by continuing your membership, when the terms have been updated, you accept and agree to these updated terms.
Our terms are governed by English Law and you irrevocably submit to the exclusive jurisdiction of the courts of England.
